Terms and Conditions for Transylvania Forever
These terms and conditions (“Terms”) govern the access and use of the website transylvaniaforever.com (“Site”), operated by Transylvania Forever SRL (“Transylvania Forever” or “we”), a Romanian company. By using this Site, you agree to be bound by these Terms. If you do not agree with these Terms, you may not use this Site.
Scope of Services
Transylvania Forever sells souvenirs and plots of one square foot (“sqft”) in Transylvania through the Site. All sales are final, and Transylvania Forever reserves the right to refuse service or cancel orders at anytime.
Product Description
2. Transylvania Forever makes every effort to accurately describe the souvenirs and plots of sqft in Transylvania sold on the Site. However, we do not guarantee that the descriptions or other content on the Site are accurate, complete, reliable, current, or error-free
Right, to Relocate:
3. In the instance of unexpected circumstances such as, but not limited to, natural disasters, political turmoil, enforcement of a community right, or other acts of God leading to the sale of any property, Transylvania Forever reserves the right to relocate and reassign the souvenir plots and dedications to another land or estate of similar standing in Transylvania. You will be notified, and we will redo the paperwork for free.
Prices and Payment
4. All prices for souvenirs and plots of sqft in Transylvania are displayed in Euro (EUR) and include applicable taxes. Payment is due at the time of purchase, and we do not offer any financing options. We accept payment by credit card, debit card, and PayPal.
Shipping and Delivery
5. We currently offer shipping to select countries. Shipping costs will be calculated and displayed at the time of purchase. We will deliver your order within the estimated delivery time frame. However, we do not guarantee delivery dates. We are not responsible for any delays or errors caused by the shipping carrier.
Intellectual Property
6. All content on the Site, including but not limited to text, graphics, logos, images, and software, is the property of Transylvania Forever or its licensors and is protected by Romanian and international copyright laws. You may not use any content from the Site without our prior written consent.
Disclaimer of Warranties
7. Transylvania Forever makes no representations or warranties of any kind, express or implied, regarding the Site, the souvenirs or plots of sqft in Transylvania, or any other products or services sold through the Site. We do not warrant that the Site will be uninterrupted or error-free, that defects will be corrected, or that the Site or the servers that make it available are free of viruses or other harmful components.
Limitation of Liability
8. To the extent permitted by law, Transylvania Forever and its affiliates, officers, directors, employees, agents, and licensors shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from or in connection with the use or inability to use the Site or any products or services sold through the Site, including but not limited to lost profits, lost revenue, or lost data.
Indemnification
9. You agree to indemnify, defend, and hold harmless Transylvania Forever and its affiliates, officers, directors, employees, agents, and licensors from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from or in connection with your use of the Site or any products or services sold through the Site.
Modification and Termination
10. Transylvania Forever reserves the right to modify or terminate these Terms without prior notice. Your continued use of the Site after any such modifications shall constitute your agreement to be bound by the modified Terms. We may also terminate your access to the Site or any products or services sold through the Site at any time, without prior notice and for any reason.
Governing Law and Dispute Resolution
11. These Terms shall be governed by and construed under the laws of Romania without regard to its conflict of law provisions. Any dispute arising out of or in connection with these Terms or the use of the Site shall be resolved through binding arbitration following the rules of the Romanian Court of International Commercial Arbitration. The arbitration shall take place in Romania and be conducted in English. The award rendered by the arbitrator shall be final and binding, and judgment may be entered upon it in any court of competent jurisdiction.
Severability
12. Suppose any provision of these Terms is held invalid or unenforceable. In that case, such provision shall be struck, and the remaining provisions shall be enforced to the fullest extent possible.
Entire Agreement
13. These Terms constitute the entire agreement between you and Transylvania Forever concerning the use of the Site and any products or services sold through the Site. Any additional or conflicting terms proposed by you shall not be binding on Transylvania Forever unless expressly agreed to in writing.
